Terms of Service

1. Agreement to Terms

By accessing or using the SigSpan platform ("Service"), operated by Infrastructure and Integration Group (IIG), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Service Description

SigSpan provides an email-to-text (email-to-SMS) bridge platform that converts incoming email alerts into text message (SMS) notifications delivered to designated phone numbers. The Service is designed exclusively for transactional, non-promotional business communications such as IT system alerts, server and infrastructure monitoring notifications, and on-call team alerting. The Service is not intended or permitted for marketing, promotional, advertising, affiliate marketing, lead generation, or other solicitation messaging, and any such use is prohibited.

3. Account Registration

To use the Service, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Promptly notify us of any unauthorized access to your account
  • Accept responsibility for all activity that occurs under your account

4. Free Trial

New accounts receive a 15-day free trial with full access to all platform features. After the trial period, your account automatically converts to pay-as-you-go pricing. No credit card is required to start a trial. Trial extensions may be requested by contacting us at admin@sigspan.com.

5. Pricing and Payment

SigSpan uses tiered, pay-as-you-go pricing with no monthly platform fees:

  • First 1,000 SMS per month: $0.10 per message
  • 1,001 – 5,000 SMS per month: $0.07 per message
  • Over 5,000 SMS per month: $0.05 per message

You will be billed monthly based on your actual SMS usage. Invoices are sent via email with a detailed breakdown of message counts and tier-based pricing. Payment is due within 30 days of invoice date.

6. Acceptable Use

You agree to use the Service only for lawful purposes. You may not:

  • Send unsolicited marketing or promotional messages
  • Send messages to recipients who have not consented to receive them
  • Use the Service to harass, threaten, or abuse any person
  • Transmit malicious content, spam, or phishing attempts
  • Attempt to circumvent TCPA opt-out mechanisms
  • Resell or redistribute the Service without written permission
  • Interfere with or disrupt the integrity of the Service
  • Transmit protected health information (PHI), payment card data, Social Security numbers, or other regulated sensitive personal data

7. SMS Messaging Program Terms & TCPA Compliance

Program description. SigSpan delivers transactional, service-related text messages (SMS) — IT system alerts, server and infrastructure monitoring notifications, and on-call team alerts — that originate from the systems you connect to the Service. SigSpan does not send marketing, promotional, advertising, affiliate marketing, or lead-generation messages, and such use is prohibited.

Message frequency. Message frequency varies and depends on the volume of alerts generated by your connected systems. Message and data rates may apply.

Opt-out and help. Recipients may opt out at any time by replying STOP; no further messages will be sent to that number. Reply HELP for assistance, or contact admin@sigspan.com. SigSpan automatically processes STOP and opt-out requests, and messages will not be delivered to numbers that have opted out. Mobile carriers are not liable for delayed or undelivered messages.

Your TCPA responsibilities. SigSpan provides tools to support compliance with the Telephone Consumer Protection Act (TCPA), but you are responsible for:

  • Obtaining and documenting prior express consent from SMS recipients before adding them
  • Ensuring your use of the Service complies with TCPA and applicable state laws
  • Honoring opt-out requests from recipients
  • Maintaining records of consent as required by law

Recipient phone numbers and SMS opt-in and consent data are used solely to deliver the Service and are never shared with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy for details.

8. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to provide advance notice of planned downtime. The Service is intended as a supplementary alerting mechanism and should not be relied upon as the sole means of monitoring critical infrastructure or systems.

9. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the Service, you consent to the data practices described in the Privacy Policy.

10. Intellectual Property

The Service, including its design, features, and documentation, is the property of Infrastructure and Integration Group (IIG). You retain ownership of the content you transmit through the Service. You grant us a limited license to process your content solely for the purpose of providing the Service.

11. Limitation of Liability

To the maximum extent permitted by law, SigSpan and IIG shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, or damages resulting from missed, delayed, or undelivered alert notifications, even if SigSpan has been advised of the possibility of such damages, arising from your use of the Service. Our total aggregate liability shall not exceed the greater of: (a) the total fees paid by Customer in the three (3) months immediately preceding the claim, or (b) five hundred dollars ($500.00).

12. Indemnification

You agree to indemnify and hold harmless SigSpan, IIG, and their officers, employees, and agents from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any applicable law or regulation, including TCPA.

13. Termination

You may stop using the Service at any time. Since there are no monthly fees or contracts, you will only be billed for messages already sent. We may suspend or terminate your access to the Service if you violate these Terms or engage in activity that harms the Service or other users. We will provide reasonable notice before termination unless immediate action is required to prevent harm.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a revised "Last updated" date. Continued use of the Service after changes constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of the State of Colorado. Any dispute that cannot be resolved through good-faith negotiation within thirty (30) days shall be submitted to binding arbitration administered by JAMS under its Streamlined Arbitration Rules, with proceedings conducted in Archuleta County, Colorado. You and IIG waive the right to a jury trial and to participate in any class action proceeding.
